Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the Mailwynx website at mailwynx.com (the "Site") and your purchase of licenses to the Mailwynx software. By using the Site or buying a license, you agree to these Terms. If you do not agree, do not use the Site.

1. Who we are

The Site and Mailwynx are operated by Azhar Alam (sole proprietor), trading as Mailwynx ("we", "us"), based in Delhi, India. You can contact us at support@mailwynx.com.

2. The software is licensed separately

Mailwynx is self-hosted software licensed to you under our End-User License Agreement (EULA). These Terms cover your use of the Site and the commercial transaction (accounts, orders, and payment); the EULA covers your use of the software itself. If there is a conflict about the software, the EULA controls.

3. Accounts

To buy or trial Mailwynx you create an account with a valid email address. You are responsible for keeping your login credentials and license key confidential and for all activity under your account. Tell us promptly if you believe your account or key has been compromised. You must provide accurate information and be authorised to accept these Terms on behalf of any organisation you represent.

4. Orders, plans and pricing

Mailwynx is currently offered as a one-time purchase of mailbox-migration packs (for example, 100 or 300 mailboxes), each granting a perpetual, non-expiring balance of destination-mailbox migrations added to your license key, as shown on the pricing page. Prices, packs, and included mailbox counts are those displayed at the time of purchase. We may change prices and packs at any time, but changes do not affect a purchase you have already completed. Unless stated otherwise, prices are exclusive of any taxes, which are your responsibility where applicable.

5. Payment

Payments are processed by Razorpay, our third-party payment processor. By submitting an order you authorise the charge for the selected plan and agree to Razorpay's terms in respect of the payment. We do not receive or store your full card or bank details. An order is complete only when payment is confirmed.

6. License delivery

After payment is confirmed, we issue your license key and email it to the address on the order, usually within minutes. It is your responsibility to provide a correct email address and to check spam folders. If your key does not arrive, contact support@mailwynx.com and we will help.

7. Free trial

New accounts may receive a free trial. The trial lets you preview migrations without limit and run a capped number of real mailbox migrations (currently three distinct destination mailboxes) before purchasing. Trials are for evaluation and may have other limits. No payment is required to start a trial, and a trial does not obligate you to buy.

8. Refunds and cancellation

Our refund and cancellation terms, including any statutory withdrawal rights for EU consumers, are set out in our Refund & Cancellation Policy, which forms part of these Terms.

9. Acceptable use of the Site

You agree not to misuse the Site: no attempting to breach security, scrape at scale, disrupt the service, probe for vulnerabilities without authorisation, or use it to break the law. You also agree not to share, resell, or publish your license key.

10. Intellectual property

The Site, the Mailwynx name and logo, and the software are owned by us or our licensors and are protected by intellectual-property laws. These Terms grant you no rights in our trademarks or content except as needed to use the Site and, under the EULA, the software.

11. Third-party services

The Site links to and relies on third parties (such as Razorpay for payments and our hosting and email providers). We are not responsible for third-party services, their availability, or their terms. The software connects to platforms such as Microsoft 365 and Google Workspace using credentials you provide; your use of those platforms is governed by their own terms.

12. Disclaimers

The Site is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by law. We do not warrant that the Site will be uninterrupted or error-free. Warranties relating to the software itself are addressed in the EULA.

13. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business, arising out of or related to the Site or these Terms. Our total aggregate liability arising out of or related to these Terms will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Indemnity

You agree to indemnify and hold us harmless from claims, damages, liabilities, and expenses arising from your use of the Site or your breach of these Terms.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by a new version number and date at the top of this page. Continued use of the Site after changes take effect constitutes acceptance.

16. Governing law

These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. The courts of Delhi, India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms.
